Terms & Conditions

Agreement between Empower Success Coaching (Coach) and the Client.  Whereby Coach agrees to provide coaching services for the Client on agreed upon topics. Success Coaching is an alliance between the Coach and the Client in a thought provoking process that inspires the Client to maximize business and personal growth.

The Success Coaching Relationship
The Coach serves as a partner in self-discoveries, personal growth, goal-setting and goal attainment.  The Coach's role is to help the Client discover within themselves, the beliefs or issues that are blocking the path and keeping them from getting all they want out of business/life, and to help elicit from them what the best solutions or a new way of being and just to live more of the life they desire.

 Success Coaching is not therapy and Empower Success Coaching is not a licensed therapist. A Success Coach does not diagnose or treat disorders. If you are currently in therapy, you are strongly encouraged to inform your therapist that you are engaged in a Success Coaching arrangement.

 

Responsibilities:

  • Client is responsible for creating and implementing his/her own physical, mental and emotional well-being, decisions, choices, actions and results. As such, Client agrees that the Coach is not and will not be liable for any actions or inaction, or for any direct or indirect result of any services provided by the Coach.
  • Client understands that coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
  • Client understands that coaching is not to be used as a substitute for professional advices by legal, mental, medical, or other qualified professional and will seek independent professional guidance for such matters. If Client discloses that he/she is currently under the care of a mental health provider, Coach will recommend that Client inform the mental health provider.

Services:
The parties agree to engage in a Coaching Program as selected by the Client. Sessions will take place over the telephone, unless otherwise agreed upon. Coaching is delivered during regularly scheduled sessions as scheduled by the Client. The Client will determine the overall direction of the coaching, its pace, and eventual outcomes based on the Client's level of commitment and focus during the coaching process.

Client Responsibilities:
In order for coaching to be most effective, the Client must make a commitment to take an active part in the process, which may include identifying your goal and desired outcomes, doing agree-upon homework assignments and follow-up activities on your own time between sessions. As the Client, you supply the agenda or topic of discussion for each session. It is important that you are truthful, open, and authentic, saying what you believe and feel. The Success Coach will assist you to realize your own potential, and respect your right to make your own informed and responsible decision; thus, you need to be aware that results cannot be guaranteed, and that you are entering into coaching with the understanding that the effort and energy that you put into coaching will largely determine the outcomes you experience.

Coaching Calls:
The Client is responsible for selecting the one-on-one which details the call length

One-on-One Coaching

For one-on-one sessions, the Client will be responsible for scheduling the call time. Client may be responsible for coaching session fees for any regularly scheduled calls that the Client cancels with less than 48-hour notice. Cancellation notice should be given by email. The Coach is under no obligation to reschedule a missed coaching session unless advance cancellation is given.

Termination of Services:

For one-on-one coaching, either the Client or Coach may terminate this agreement at any time with one-weeks' written notice. The Coach will refund the Client for any unused portion of any pre-paid coaching services.

Confidentiality:
This coaching relationship, as well as all information (documented or verbal) that the Client shares with the Coach as part this arrangement, is bound to confidentiality by the ICF Code of Ethics but is not considered a legally confidential relationship (like medicine or law). The Coach agrees not to disclose any information pertaining to the Client without the Client's written consent. The Coach will not disclose the Client's name as a reference without the Client's consent. Confidential information does not include information that: was in the Coach's possession prior to its being furnished by the Client; is generally known to the public or in the Client's or industry; is obtained by the Coach from a third party, without breach of any obligation to the Client; and is independently developed by the Coach without use or reference to the Client's confidential information; or that the Coach is required by law to disclose.

Release of Information:
The Coach retains the right to share the Client's name and number of coaching hours as required for documentation for any coaching certifications. That process may require the Client's name, contact information, dates and /or number of coaching hours. By agreeing to these Terms and Conditions, the Client agrees to have only the above-mentioned information shared with the credentialing organization for the sole purpose of verifying the coaching relationship, whereby, personal notes will not be shared. According to the ethics of this profession, topics maybe anonymously and hypothetically shared with other coaching professionals for training, supervision, mentoring, evaluation, further coach professional development and/or consultation purposes.

Limited Liability:
Except as expressly provided in this agreement, the Coach makes no guarantees or warranties, express or implied. In no event will the Coach be liable to the Client for consequential or special damages. Notwithstanding any damages that the Client may incur, the Coach's entire liability under this agreement, and the Client's exclusive remedy, will be limited to the amount paid by the Client to the Coach under this agreement for all services rendered up until the termination date.

The Client agrees to utilize these business success and personal life coaching services with the full understanding that Patricia Richardson-Hurndon and Empower Success Coaching and its employees and volunteers are in no way liable for the Client's decisions, actions and outcomes. Client also agrees to hold Patricia Richardson-Hurndon, Empower Success Coaching and its employees and volunteers free of all liability and responsibility for any adverse situations created as a direct or indirect result of a specific referral, advice given or any actions taken while working with or as a direct result with Empower Success Coaching or Patricia Richardson-Hurndon.



NOTIFICATION OF CHANGES

Empower Success Coaching may change these policies and conditions from time to time as it sees fit and your continued use of the site signify your acceptance of any adjustment to these terms. You should check this section periodically to ensure that you are happy with any changes.

These terms and conditions constitutes the entire agreement between the parties with respect to its relationship and supersede all prior oral written agreements, understandings and representations to the extent that relate in any way to the subject matte hereof. No waiver of any of the provisions shall bind either party unless set forth in a writing specifying such waiver, consent or amendment signed by both parties.

The headings of these Terms and Conditions are provided for convenience only and shall not affect its constructions and interpretation.

By using the Site, you agree to these Terms and Conditions, without modification, and acknowledge reading them. We reserve the right to change these Terms and Conditions or to impose new conditions on use of the Site, from time to time, in which case we will post the revised Terms and Conditions on this Site. By continuing to use th Site after we post any such changes means you accept the new Terms and Conditions with the modifications.


CHILDREN

To access or use the Site, you must be 18 years or older and have the requisite power and authority to enter into these Terms and Conditions. We do not knowingly collect or solicit data online from or market online to children under the age of 18.
